How is Sexual Assault Defined in Canada?

First off, it’s important to know what defines “sexual assault” in Canadian law. The Supreme Court of Canada ruled that sexual assault is any act that intentionally exploits the sexual integrity of the victim. In essence, sexual assault runs the gamut from unwanted touching to rape.

Several factors are considered when reaching a verdict such as the part of the body violated, the nature of contact, the situation, specific words and gestures after the act is committed, and threats accompanied by force. Each circumstance is different and authorities will also take them into account for your case. 

 

What Are the Penalties of Sexual Assault? 

If convicted and sentenced for sexual assault, incarcerations and penalties are often severe. An indictable offence could include prison time of up to 10 years. If the victim is under the age of 16, the term might go up to 14 years. 

For an offence punishable on summary conviction, the minimum sentence is six months with a maximum of two years.

What Can I Expect in Court? 

Much like a domestic assault charge, a sexual assault charge is filed with the police and sent to prosecutors, from which moment on it “belongs” to the Crown. This means that the alleged victim cannot withdraw the charges or have them dropped. 

From there, it’s out of your hands and your defence attorney will have to fight on your behalf to avoid a conviction. 

If there is insufficient evidence to support the case or if the alleged victim recants their claims, then you may have a better chance of not getting charged. However, such cases are uncommon. When it does reach court, you’ll have the option to plead guilty or not guilty.
