Sexual Assult

The client was a successful business executive whose adult niece had accused him of repeated sexual assaults over a 2-year period. The Complainant and another witness testified against the accused.

Resolution

The client was a successful business executive whose adult niece had accused him of repeated sexual assaults over a 2-year period. The Complainant and another witness testified against the accused.

Imparied Care & Control

The client is found unconscious and drunk behind the wheel of his car. He was charged with ‘impaired care and control’ and ‘over 80 care and control’. The breath readings were more than twice the legal limit.

Resolution

I brought forward credible evidence that the client had no intention to drive the car. The Judge found him not guilty.

Home Invasion Robbery

Client is charged with having participated in a home invasion robbery during which he was accused of assaulting the homeowner and stealing valuable jewellery. The homeowner testified at the preliminary hearing and identified my client as one of the robbers.

Resolution

After a thorough investigation by my office, I brought forward evidence showing that the homeowner had lied and that the incident had never taken place. The Crown withdrew the charge before the trial date was set.

Broke Into Home

Police officer accused my client of having broken into her home. The officer testified that she saw my client from a distance of 6 feet in her home and was absolutely certain that my client was the burglar.

Resolution

I discredited the officer’s identification testimony to the point that it took the jury just over 2 hours to find my client ‘not guilty’ of this very serious crime.

100 Counts of Fraud

Client was charged with more than 100 counts of fraud.

Resolution

The Crown asked that the charges be withdrawn during the trial because of the very effective challenges to the evidence of the investigating officers and the complainants. Those cross-examinations showed that there was no credible evidence of any wrongdoing.
